The divorce is run through either the Regional or High Courts, and is the longest type of divorce process – the minimum time in which these divorces are finalized is 2 – 3 years.
the unopposed divorce is quite simple in that a settlement is reached between the parties – usually with the help and facilitation of their legal representatives – drawn up and signed by each party before the divorce action is even instituted. thereafter, the process takes a few months to run through the courts, and the parties can be divorced within 3-5 months of the divorce action being instituted.
The default divorce, happens in situations where a divorce action is instituted and the other party simply ignores the summons. A court may then grant a divorce based on what is requested in the papers instituting the action.
